When parents divorce, the child custody agreement can complicate otherwise easy decisions. Moving is something you can usually do without needing approval or much thought. That’s not always the case after a divorce. Consider the following to know whether or not you can move your children out of the state:
- Child’s Interest: First and foremost, we want to consider if moving is in the child’s best interest. If you share custody, the distance needed to travel, holidays, and time split with the other parent need to be weighed in the decision. Once you’ve factored that in, you’ll know if you want to move forward.
- Primary Custody: The child will live with the primary custodial parent. Knowing how that may impact the time you have with your child is important when thinking about moving. You want to be willing to make that trip or exchange your child on designated days and times.
- Custody Changes: You can request the custody agreement to be changed regarding the primary custodial parent or the visitation when wanting to relocate. After your request, the ultimate decision is up to the judge. Whether or not it’s in the child’s best interest and how it impacts the relationship will be part of the approval or denial of amendments.
- Consent and Restrictions: Some states have laws you must adhere to in order to be allowed to move. In Ohio, you must receive permission from the other parent or the court to relocate. The custodial parent is often required to notify the noncustodial parent (usually in writing) of the intended relocation and the time period for this move.
