Illness and death are a part of life that everyone will handle at some point in life. Sadness and tragedy compound when children are/going to be left behind. It may even force family members to consider if/who should take guardianship or adopt children who have lost their parent(s).
If the parent of the children passes away with no will, often children will be temporarily placed in the care of a relative until the Court can establish guardianship. In some cases, the children may be placed in foster care while proceedings establish a guardian.
If the parent is terminally ill or unable to care for the children due to illness, they may consider placing the children in the care of a friend or relative with guardianship rights, or both parties may determine that adoption is a better option. This type of adoption procedure is called“kinship adoption.” Of the over 64,000 children and youth adopted in 2019, 36% were adopted by a relative.1 In the case of terminal illness, many may find comfort in knowing their children will remain with a familiar family circle.
The adoption process between friends or relatives is the same as a private adoption. You will first want to contact an adoption agency and an adoption attorney. You, the adopting party, and any involved agencies will need to sit down to agree on the terms and conditions of the adoption. You will need to complete all the necessary forms, and the adoptive family will likely need to undergo a home study to determine if the home will be safe for the child(ren).
The death of a loved one is often stressful and tragic. You may be unexpectedly forced into considering adopting children left behind. It can quickly become an overwhelming situation.
If you are considering adoption in any capacity, choosing the right adoption professionals to work with is one of the most important decisions. Don’t settle for the first agency or attorney you contact. Be sure you choose people you feel comfortable with and trust.
