How Trusts Work
A trust consists of three parties: the grantor, trustee, and beneficiary or beneficiaries. The grantor is the individual who starts and funds the trust. The trustee manages trust assets for the beneficiaries’ benefit. The beneficiaries are those who will share the trust assets after the grantor passes away. While alive, the grantor may also be the trustee managing and using the assets freely. Should the grantor want to close the trust and take back the assets, they can do so anytime. The only difference in placing assets in a living trust is the property or accounts are now in the name of the trust rather than directly to the grantor
Assets Upon Passing
Knowing that you have complete control over your assets in a living trust should be a relief as a grantor. Once you pass away, whomever you appoint as successor trustee takes over. When creating the trust, provisions will also be clear for successor beneficiaries. The successor trustee assumes responsibility for managing the trust for the successor beneficiaries as stipulated by the terms the grantor sets. If the grantor simply wants all property to pass to the beneficiaries, the trustee will pay any debts or expenses, divvy up assets accordingly, and dissolve the trust. For more detailed instructions, the trustee may manage the trust more carefully for paying certain expenses for beneficiaries, paying out specific amounts at set intervals, or a more regular basis percentage payment of assets or earnings.
