n Ohio, a DUI falls under statute 4511.19 | Operating a vehicle under the influence of drugs or alcohol (OVI). A blood alcohol content of 0.08 is considered under the influence. In most cases, an OVI is a misdemeanor offense. However, even a first offense conviction can result in jail time, suspension of your license, probation, and/or court-ordered counseling. Some states may require you to keep a monitoring device in your vehicle. Additionally, Ohio assesses points against your driver’s license, which can affect your insurance rates, credit rating, or even your employment.
Still, there are circumstances in which an OVI violation is a felony. In Ohio, if an offender has at least three previous OVI convictions within the last ten years or five convictions within the past 20 years, the current offense is considered a felony.
Other exacerbating factors considered for a felony charge include:
- Whether there was a bodily injury involved or if a child was endangered
- Whether any property damage resulting from the incident
- The BAC level or other intoxication level of the offender at the time of the incident
- If any other laws were broken during the incident, such as driving with a suspended license or without insurance
The penalties for a felony OVI conviction include incarceration, fines, driver’s license suspension, and forfeiture of the vehicle involved as well as the penalties imposed for any other offenses committed in conjunction with the OVI offense.
