Unless circumstances change from or were unknown at the time of the original order, Ohio law states (section 2. (E)(1)(a)) that no modifications will be made. In addition to those requirements, any proposed changes must be in the child's best interest. To understand what courts look for, you can refer to this list:
- Child’s parents wishes regarding the child’s care;
- Child’s wishes and concerns;
- Child’s interaction and relationships with parents, siblings, and any other person who may greatly impact the child’s best interest;
- Child’s home, school, and community adjustment;
- Each involved individual’s mental and physical health;
- Which parent is most likely to honor and facilitate court-appointed parenting time rights or visitation and companionship rights;
- Any failed child support payments, including all arrearages, that are required of one parent to the other by the decree;
- Any parent’s previous convictions of or guilty pleas to any criminal offense involving any act that resulted in a child being abused or neglected; any reason to believe that either parent has acted in a manner resulting in a child being abused or neglected;
- Any continuous or willful denial of parenting time to one parent by another parent subject to a shared parenting agreement by court order;
- Any parent establishing residence or planning to reside outside the custody decree’s state.
