2015 marked the year that the US Supreme Court legalized gay marriage, which allowed all same-sex couples to get married across the country. Even though a constitutional amendment was made in addition to a 2004 state law banning same-sex marriage in Ohio, the US Supreme Court decision on June 26, 2015, meant Ohio had to acknowledge gay marriages and provide equal treatment to all couples.
Civil Unions
While marriages of same-sex couples need to be recognized by Ohio, civil unions do not need to be recognized by Ohio from other states. So, although Ohio does not recognize same-sex civil unions, same-sex couples may get married in Ohio and have that marriage recognized.
Tax Differences
Same-sex couples used to have to file separate state taxes, but now they can file joint state returns. Severe tax actions from property transfers upon death are now avoidable for same-sex couples. State gift tax exemptions available to married couples now also apply to same-sex spouses.
Medical Changes
Visitation privileges can no longer be denied to same-sex partners at hospitals. Fully-insured medical plans from employers can no longer exclude married same-sex partners from coverage due to religious objections. Employers must still provide benefits.
Family law cases go beyond marriage. Unfortunately, even if it seems like splitting hairs, same-sex couples face many challenges traversing family law cases. Some foreign countries, for instance, still do not allow same-sex parents-to-be to adopt. Discrimination against same-sex couples or individuals by a court or legal representation can also be a situation to handle properly.
