Domestic violence charges may greatly impact child custody and visitation. The safety and welfare of the child is the court’s highest priority. Judges reserve the right to revoke or restrict custody and visitation for a parent if the welfare or safety is compromised. Legal and physical custody may be limited in instances of abuse, especially toward a child.

be granted temporary support.
If a protection order has been granted for a spouse or child, the court will uphold that order. If there is proof of a history of abuse but a lack of a restraining order, that evidence can still warrant mandated supervised visitation.
Parents will need to file a petition to request a modification to change their custody or visitation agreement. Physical custody, or physical care and supervision of the child, may be altered if it serves the child's best interest. Ohio courts will consider any significant change in circumstances and issue a new order if necessary.
