Your Last Will and Testament: This is likely what most people think of when estate planning is mentioned. This document designates who will receive your estate and outline any property to be authenticated in court. Without a will, the court will decide how to distribute everything. Depending on your circumstance, you may also want or need a Living Trust.
Your Powers of Attorney: What happens if something happens and you end up in a vegetative state? You need someone to make medical, financial, and legal decisions while you are incapacitated. Designating a Power of Attorney (or Powers of Attorney) will ensure affairs are handled on your behalf until you can make decisions yourself again.
Your Living Will (Advanced Directive): This sets your desires for life-sustaining treatments and other end-of-life choices to be adhered to if something happens. Document every wish clearly. Make sure they are also readily available should the need arise for responsible parties to put the information in motion.
Your Beneficiaries: Some assets have contracts associated with them that will designate a beneficiary to receive those funds. If you have a pension plan, life insurance, IRA account, or something to that effect, you choose a beneficiary when you set it up. It is helpful to coordinate your beneficiaries with any information you place in a Will, but most assets with a contract will pass to the beneficiary without regarding the content of your Will.
