Driving while under the influence packs a heavy price. Thousands of lives are lost each year to those driving while intoxicated. If you’re over 21, Ohio’s legal BAC (Blood Alcohol Content) is below .08%. However, you can get an Under Age charge at as little as .02% if you’re under 21. What consequences would you be facing? As a Minor
Even for a first-time conviction on charges for someone under 21, you could face up to 30 days in jail, a $250 fine, and a license suspension of 90 days to 2 years. Plus, you receive 4 points against your driving record.
You could also be required to retake the driving exam, change your plate to a DUI/yellow license plate, take an 8-hour driving class, spend five days in a detention facility, receive alcohol treatment, install an ignition interlock device, remain on probation until license suspension is over, and provide proof of insurance periodically to the Ohio BMV.
Driving drunk is illegal. Drinking under the age of 21 is also against the law; this can add up to 6 months of jail time and a fine of $1,000.
As an Adult
The penalties rise with the BAC levels. If you are 21 or older, your first DUI/OVI (Driving Under the Influence/Operating a Vehicle Impaired) may come at the cost of a $500-1,000 fine, three to 180 days in jail, 6 points against your driving record, and six months to 3 years license suspension. Other requirements may be added, like mandatory alcohol treatment, installing the ignition interlock device, and probation in some cases.
You do have the right to refuse a breathalyzer test, but it will come with a license suspension for a year. It is possible to get the ability back to drive to school and work after 30 days. Know that your refusal will not prevent a conviction necessarily either.
These convictions will largely impact your future as they follow you for the rest of your life. Employers and universities can look at these records and may use that as information to accept or deny you for a job or opportunity. Insurance premiums will likely be higher as a result, too. Bear in mind that the penalties mentioned above are all the minimum charges. Other factors can significantly increase your charges and, in turn, the penalties you face.
